In California county the District Attorney's office can prosecute citizens for drunk driving even if their breath or blood-alcohol (BAC) tests are well under the legal limit of 0.08 per cent. Persons may be prosecuted based on their ability to operate a motor vehicle safely. The authors of California Drunk Driving Law, Paul Burglin and Barry Simons, have compiled an informational guide online to help citizens beat the DUI (Driving under the Influence) laws in California.

The DUI guide provides a break down of the drunk driving laws which citizens are susceptible to if they are charged with drunk driving. Most of these laws make it illegal for persons to drive with a level 0.08 per cent, or higher, of alcohol or other narcotics in their blood system or to be caught with that same level three hours after driving. Citizens will also find that the level for commercial drivers the limit is 0.04 at the time of testing, also within three hours of driving. Citizens that have been diagnosed as addicted to alcohol or other narcotics are also subject to prosecution if they are not in rehabilitation program. The DUI laws described in the informational guide also cover license suspensions, accidents that occur during a drunk driving incident, failure to complete a BAC test amongst others.

Also in the DUI informational guide is how to estimate your blood alcohol level. This is measured according to your gender (with an explanation of gender differences in alcohol consumption), weight, type of drink consumed and the number of hours you have been drinking. The website also gives a rough guide as to what levels constitute drunk driving.

In addition to that, the guide provides a summary of possible defenses that offenders can use of they are charged with DUI. Amongst these are whether or not it was an emergency, if you were seen behind the wheel while the vehicle was moving, if your drink was spiked, if you had an unexpected reaction to medication, if you suffer from diabetes or hypoglycemia, if you had a fever during the test and so on.

The DUI guide also tells you how to look for a suitable attorney to handle your case. As they put it, 'You would want a physician who specializes in the specific area of treating heart ailments. The same principle applies for finding a lawyer!' The guide lists such requirements as that the lawyer should be a member of the DUI Lawyers Association and the National College of DUI Defense. Other questions that offenders are advised to ask are whether or not the lawyer goes to trial often, if they have ever been suspended by the State Bar of California and the length of time they have been in practice.
